Applicability
This Terms and Conditions agreement (“Agreement”) governs your use of this website www.mycodexa.ai, any other websites hosted under the domain of mycodexa.ai (“Website”), mobile applications for the MyCodexa.ai brand, email communications received on [e.g.,  and text/Whatsapp messages from numbers associated with the MyCodexa.ai service (collectively, “Platform”). www.mycodexa.ai is a brand of Karkinos Health Private Limited. The Platform is owned and operated by Karkinos Health Private Limited, a private limited company registered under the provisions of the Indian Companies Act, 2013 having its registered office 9th Floor, Maker Chamber IV, 222, Nariman Point, Mumbai - 400021(“Company”).
The Company reserves the right to modify the terms contained in this Agreement at any time by posting such modifications on its Website. The modified Agreement would be effective from the date of modification that is posted by the Company on its Website. If you do not agree to any term that is contained in this Agreement, please immediately cease your use of the Platform.
“You” or the “User” in this Agreement refers to any person who uses a Platform. “Service” in this Agreement refers to any capability/functionality that is offered by the Platform that can be used by a User.
Use of Service
The Service uses information provided by you directly or from reports or devices (“User Information”), if you consent to sharing such reports and/or data collected on devices with the Service. If you consent to sharing health reports stored in your health account for use of the Service, such health reports will continue to be shared with the Service until you expressly withdraw such consent. Our data collection and processing practices are governed by our privacy policy contained in the Privacy Policy. The Service uses an automated algorithm based on a medical knowledge base derived from external sources in connection with User Information to provide you with an indicative overall status of your health. The Service is intended for informational purposes only and is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding your medical condition(s). Never disregard professional medical advice or delay in seeking it because of the Service.
The Service does not provide diagnoses for medical conditions, nor does it prescribe how you are to treat any medical issues you may have. This can only be done by consulting a medical professional. It is your responsibility to seek medical advice from a qualified practitioner for any medical conditions you may have.
The Service works purely on the basis of User Information, and in the event you enter incorrect User Information, the Service will return an incorrect result.
SMS and WhatsApp Communication Consent
As a part of the Service, the Company sends booking confirmation, information, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction or booking made by the User, via SMS, internet-based messaging applications like WhatsApp, voice call, e-mail or any other alternate communication detail provided by the User at the time of booking. The Company may also contact the User through the modes mentioned above for any pending or failed bookings, to know the preference of the User for concluding the booking and to help the User. The User hereby consents that such communications via SMS, internet-based messaging applications like WhatsApp, voice call, email or any other mode by the Company are:
upon the request and authorization of the User;
‘transactional’ and not an ‘unsolicited commercial communication’ as per the guidelines of Telecom Regulation Authority of India (“TRAI”), and
in compliance with the relevant guidelines of TRAI or such other authority in India and abroad.
The User will indemnify the Company against all types of losses and damages incurred by the Company due to any action taken by TRAI, Access Providers (as per TRAI regulations) or any other authority due to any erroneous complaint raised by the User on the Company with respect to the communications mentioned above or due to a wrong number or email id being provided by the User for any reason whatsoever.

This Platform could include technical or other inaccuracies or typographical errors & the changes could be made possible only when the Website is updated. The Company has made every attempt to ensure that the information contained in the Platform has been obtained from reliable sources, the Company is not responsible for any errors or omissions, or for the results obtained from the use of this information. All information in this Website is provided “as is”, with no guarantee of completeness, accuracy, timeliness or of the results obtained from the use of this information, and without warranty of any kind, express or implied, including, but not limited to warranties of performance, merchantability, and fitness for a particular purpose. If you download any third-party materials that the Company indexes or links to, you do so completely at your own individual risk. PRIVACY POLICY


Our privacy policy explains how information is collected, used, and disclosed by Karkinos Healthcare Private Limited (“we”, “us”, “Company”) with respect to your access and use of Company’s services, whether through our website (located at https://www.mycodexa.ai/) or Company’s mobile and web applications (collectively, the “MyCodexa.ai Platform” or the “MyCodexa.ai Service”) or through any of our other services pertaining to health, AI-driven analysis, cancer screening and/or cancer treatment. When we use the term “Personal Data” in this document, we mean any information that can be used to contact or identify you (such as your name or contact details, health reports, specific health-related information, or your medication list in combination with other information that identifies you).
IS REGISTRATION NECESSARY?
Registration is required to use the MyCodexa.ai Service which enables you to access your account information on the MyCodexa.ai Service. Registering will also enable you to recover your Personal Data in the event of change of mobile phones or reinstallation of the MyCodexa.ai Service on your mobile device. If you use or download the MyCodexa.ai Service in connection with a program offered by an employer, healthcare provider, manager, or other healthcare professional in collaboration with the Company, you may be required to register with such third party, in connection with such program and provide certain Personal Data to such provider(s). We are not responsible for the use of any Personal Data that you may decide to provide to any healthcare provider(s) or any other third parties in connection with the use of the MyCodexa.ai Service or our product offerings or services.
WHAT INFORMATION DO WE COLLECT?
If you choose to complete our registration process or send us an email to communicate with us and share medical and health-related details, provide us with supporting information, or post information or any other content to the MyCodexa.ai Service, we will collect Personal Data from you. This includes your name, email address, Aadhaar number, ABHA number, phone number, and other information such as, your vitals (weight, blood pressure, blood glucose, steps/activity), medications or supplements you are taking, and your individual preferences pertaining to your health. While availing our healthcare services, we will record the call for quality related purposes as per applicable telemedicine guidelines prevalent in India. We also collect and store any content that you upload, download or access via the MyCodexa.ai Service, which may include your Personal Data (including but not limited to pictures of your prescription or lab reports or over the counter medication that you decide to upload). If you download the MyCodexa.ai Service in connection with a program offered by a healthcare provider or any third party and enter an activation code provided to you by such party, then such third party may provide us your Personal Data. By accepting the terms and conditions on our website, including but not limited to this Privacy Policy, and by providing us your Personal Data or any other specific healthcare data or availing our services or by making use of the facilities provided by the website, it is agreed that you have voluntarily and specifically consented to the collection, storage, processing, disclosure and transfer of your Personal Data in accordance with applicable laws prevalent in India and the provisions of this Privacy Policy and any amendments to this Privacy Policy thereof. You acknowledge that you have provided your Personal Data out of your free will after identifying the purpose(s) and understanding how it will be used. You also understand and consent that the collection, storage, processing, disclosure, and transfer of any Personal Data and/or any specific health-related data shall not cause any wrongful loss to you, if it is done in accordance with the provisions of this Privacy Policy.
We may automatically collect certain information when you use the MyCodexa.ai Service, such as Internet Protocol (IP) address (if using a browser), operating system, the browser type, the address of a referring site and your activity on the MyCodexa.ai Service. This information is not treated as Personal Data unless we combine it with or link it to any of the personally identifiable information mentioned above.   • to provide our services, including any AI-driven analysis, teleconsultation services, digital risk assessment & cancer detection services, treatment reminders, or appointment reminders;

  • to respond to your emails, submissions, questions, comments, requests, and complaints and provide customer service;

  • to monitor and analyze usage and trends, and to increase the functionality and user friendliness of our services;

  • to provide content or features that match your profile or interests;

  • to send you confirmations, updates, security alerts, administrative messages and otherwise facilitate your use of, and our administration and operation of, our services; for any other purpose that is communicated to you when we collect the information;

  • to create a profile for you based on information that you have provided to us, information collected or imported from other sites or applications, or information provided to us by third parties such as your contacts;

  • to allow you to contact other users or to invite others to join or create an account;

  • to provide you with additional communications, information, such as newsletters and medical related advice;

  • to inform you of other products or services available from the Company, its brands (including MyCodexa.ai) or its affiliates;

  • to enable you to contact us and for us to respond to you to conduct surveys, promotions and contests, and to publish the results thereof;

  • for creation of your ABHA (Ayushman Bharat Health Account) ID;

  • to detect, investigate and prevent activities that may violate our policies or be illegal in nature.

WHAT INFORMATION DO WE SHARE WITH THIRD PARTIES?
We will not share the Personal Data we have collected from you, except as described below:

  • we may share your information, including Personal Data, with service providers who have a contractual relationship with us in connection with the operation of our services (these service providers have access to your Personal Data only to perform services on our behalf and are obligated not to disclose it or use it for any other purposes);

  • if you access the MyCodexa.ai Service in connection with a program offered by a healthcare provider/third party, enter an activation code provided to you by the healthcare provider/ third party or otherwise authenticate to a healthcare provider/ third party in the MyCodexa.ai Service, we may provide Personal Data about you to the healthcare provider/ third party, including data related to your use of, and interaction with, the MyCodexa.ai Service.

  • we may aggregate Personal Data from multiple users in a manner that removes the ability to associate Personal Data with an individual user (“Aggregated Information”), and share the Aggregated Information with third parties on an anonymized basis for industry analysis, demographic profiling, and other similar purposes;

  • when you give us your consent to do so, including if we notify you that the information you provide will be shared in a particular manner and you provide such information;

  • when we believe in good faith that we are lawfully authorized or required to do so or that doing so is reasonably necessary or appropriate to comply with the law or legal processes or respond to lawful requests or legal authorities, including responding to legal notices, warrants or court orders; and

  • to enforce or apply our privacy policy, our terms of use or our other policies or agreements, and to investigate misuse of our IT systems.We are not responsible for the actions of service providers or other third parties, nor are we responsible for any additional information you provide directly to any third parties.

RESTRICTIONS AND REQUESTS
You have the right to request that we restrict use or disclosure of Personal Data for treatment, payment or health care operations, disclosure to persons (who have been legally nominated by you) involved in your health care or payment for health care, or disclosure to notify family members or others about your general condition, location, or death. We shall comply with all applicable laws and in the event of any restriction that we agree to, we will comply with the same in accordance with the applicable legal standards, that applies to your Personal Data.
Please find our consent withdrawal form (available upon request or on our Website). Kindly fill in the necessary details and sign it before sending it to our Grievance Officer at grievances@karkinos.in. Our Grievance Officer will strive to address your concerns within seven working days after receiving your communication.
LINKS TO OTHER SITES OR APPLICATIONS
The MyCodexa.ai Service may contain links to other sites or applications. Any information you provide on those sites or applications is provided directly to the owner of that site or application and is subject to that party’s privacy policy. Our privacy policy does not apply to such sites, and we are not responsible for the content or privacy and security practices and policies of those sites.
WHAT STEPS DO WE TAKE TO PROTECT YOUR INFORMATION ONLINE?
We understand how crucial it is to safeguard your Personal Data and we take reasonable measures to ensure its security.

ACCESSING AND MODIFYING YOUR INFORMATION

Once you withdraw your consent to share the Personal Data collected by us, we shall have the option not to fulfil the purposes for which the said Personal Data was sought as per applicable legal standards. We will take steps to delete your Personal Data within 30 (thirty) days, but some information may remain in archived/backup copies for our records and as otherwise required by applicable laws As a MyCodexa.ai Service user, you can request to amend your Personal Data if it is inaccurate or incomplete. INTERNATIONAL USERS
If you are located outside India and choose to provide Personal Data to us, we may transfer your information to India and process it there (or any other country where we operate). By using the MyCodexa.ai Service, you consent to the collection, transfer, use, storage and disclosure of your Personal Information or data as described in this Privacy Policy.
OUR POLICY TOWARD CHILDREN
The MyCodexa.ai Service is not intended for, nor do we knowingly collect information from, minors under the age of 18. In the event, our Company treats children and minors under the age of 18 years for any health-related analysis or illness, our Privacy Policy will apply to their legal guardians as per applicable Indian laws.
